The petition comes on the heels of a 3 judge panel decision that upheld Alta’s right to refuse snowboarders from riding within its ski area boundaries. And although the land Alta operates on public land, the USFS also backed Alta’s anti-snowboarder stance.

The petition to reconsider the ruling was filed on June 3rd and so far a hearing to consider the motion has yet to be scheduled. The petition urges all 12 judges of the court to reverse a precedent that might prevent future discrimination suits on federal land from gaining necessary traction.
