Analyzing snowboarding/skiing collisions is usually a pretty easy task. Typically the uphill skier or rider is at fault, as they’re responsible for controlling speed and ensuring that they have enough time and space to stop or turn when necessary. This collision seems a bit more difficult to find an answer to. Neither the skier nor the snowboarder really seem to be further uphill than the other and it all happens so fast. Personally I’m going to say the kid was at fault, as he was clearly flying out of control while the snowboarder seemed to be making a nice, consistent turn. There’s no way the skier was going to stop quickly with his stance as he careened towards the collision. This was a child, so you can’t put the blame too much on him, but skiing should always be done with control. It’s more an issue of space between others and ability to stop than it is ability to stop.
Remember to always follow the skier responsibility code when on the mountain, and parents, make sure your kids are doing so too.

- Always stay in control. You must be able to stop or avoid people or objects.
- People ahead or downhill of you have the right-of-way. You must avoid them.
- Stop only where you are visible from above and do not restrict traffic.
- Look uphill and avoid others before starting downhill or entering a trail.
- You must prevent runaway equipment.
- Read and obey all signs, warnings, and hazard markings.
- Keep off closed trails and out of closed areas.
- You must know how and be able to load, ride and unload lifts safely. If you need assistance, ask the lift attendant.
- Do not use lifts or terrain when impaired by alcohol or drugs.
- If you are involved in a collision or incident, share your contact information with each other and a ski area employee.
