In any legal sense, the uphill skier is at fault. Every time (unless we’re talking in the terrain park, then things get a bit more complicated). But Casey is 100% right, you have to be aware when you’re on the mountain. Look where you’re turning, keep an eye uphill. Not being at fault isn’t going to fix a broken bone.
The skier, though, is definitely behaving very poorly in this clip. You can’t be going that fast if you’re that close to people. If you’re not in control, you’re going too fast. If you’re not in control, you’re going to crash. It’s not that complicated of a concept.
