If you owned an Ikon Pass during the 2019-20 season, you may be entitled to a partial refund. BusinessDen reports that the Alterra Mountain Company, which owns a variety of ski resorts and is the seller of the Ikon Pass, settled a class action lawsuit in U.S. District Court. The class action lawsuit, which originally appeared in a variety of states, eventually consolidated into this one case.

They are being forced to pay $17.5 million in ski pass credits, which will range from $150 to $10. In addition, they have to pay $2.9 million in attorney fees to the plaintiffs. The compensation is based on how many days you used during the 2019-20 winter, which was stopped in the middle of March due to the Covid-19 pandemic.

The settlement allows people to use the credits on a 2023-24 or 2024-25 Ikon Pass, which will be automatically deposited into people’s accounts. There was also the option to use the credit for a lift ticket at one of their properties, but you needed to submit a claim to the plaintiffs by January 2nd. If you excluded yourself from the lawsuit, you won’t get a refund.

The plaintiff’s argued that Ikon not having a pandemic provision in their legal terms, along with Vail Resorts’ pandemic discounts for the 2020-21 season, helped bolster their case. Alterra argued that the lawsuit was excessive and that passholders are guaranteed a set number of months to shred was based on faulty logic. Here’s what Alterra argued in their motion to dismiss back in October 2020:

“Such a promise would make no sense for something as variable as a ski season. Just as pass holders are not required to pay extra when conditions allow the ski season to extend into May, June, or even July, neither are they entitled to a refund when conditions require resorts to close in mid-March”
