While I’m sure this was unintentional, there is no doubt the snowboarder was uphill and at fault. The skier kid’s change of course was not in his line of vision but that’s not the skier’s responsibility. Bottom line he should have given a wider berth and kept an eye on him while passing. Always pass with care because you just don’t know what the downhill skier might do:
