A judge in Colorado has ruled that David Lesh illegally used National Forest Lands for publicity stunts to promote his company. According to the judge, Lesh illegally used these lands for commercial purposes by stirring up controversy to bring attention to his clothing brand.

Lesh’s stunts included bringing a snowmobile to Keystone Resort while it was closed during the COVID-19 pandemic and filmed himself sending jumps in the terrain park. Other incidents include a social media post showing Lesh defecating in a pristine Colorado mountain lake. He was also fined for harassing a bull moose at Independence Pass and setting a bunch of grocery carts on fire in Boulder.

Lesh claims that after each of these incidents, his clothing line saw sharp increases in sales. This can easily be classified as publicity stunts. According to Lesh’s logic, any attention is good attention. It is hard to argue that he has certainly become a talking point.

Lesh was convicted of two petty offenses. He will need to pay restitution to Keystone for the trespassing that resulted in commercial gain. Attorney’s from both sides will hammer out the amount of restitution. Lesh will be sentenced after that amount is determined.
