screen-shot-2016-12-31-at-4-16-45-pmThe owners of Ski Liberty in Pennsylvania is asking a federal judge to throw out a lawsuit filed by a Maryland man who claims the resort was negligent for allowing a hazardous cliff on the resort and not erecting warning signs and safety barriers according to pennlive.com

Quan Vu of Bethesda claims the accident occurred around 9 p.m. on Jan. 23, 2015 when a snowboarder cut him off and to avoid him he skied onto what he thought was a clear path along the slope.  It lead him to an “artificial cliff” which he skied off of into a pile of rocks. 

According to his lawsuit, Vu suffered 21 broken ribs, both of his lungs were punctured, his hip was shattered, his skull was fractured, his liver was lacerated, and he sustained spinal, nerve and vision damage and a separated shoulder. He is seeking more than $75,000 in damages from the resort.

The resort’s lawyer, Anthony W. Hinkle, claims Vu should have understood, “downhill skiing is an inherently dangerous sport” and “Vu signed away his right to sue Ski Liberty when he placed his signature on a release to get a season pass”

Ski Liberty is denying all of Vu’s allegations and claim the lawsuit breached the release he signed.  Judge John E. Jones III will decide whether to allow the case to continue.url
