As reported by Summit Daily, the children of Jason Varnish have hired a Denver-based law firm in pursuit of litigation against Vail Resorts.

Varnish, 46, died after becoming asphyxiated on Vail’s Chair 37 in the Blue Sky Basin area on February 13th. It appears that the family will pursue financial compensation from Vail for the accident. Witnesses stated that the chairlift’s seat was in the up-right position which could have led to Varnish’s death.

Varnish’s family has hired Burg Simpson who has extensive experience in litigation against ski resorts.
