The Aspen Times is reporting that Joseph Lipsey III, 56, and his wife, Shira Lipsey, 44 will not be facing charges of distribution of cocaine to a minor. The charge would have carried a mandatory minimum prison term of eight years.

Aspen prosecutors felt that there was not enough evidence to convict the Lipsey’s of the serious charge.

The Lipsey’s were facing a total of 41 charges related to parties thrown at their Aspen Highlands home.

According to court documents, there is cell phone footage from a party at the Lipsey’s home that shows Shira Lipsey with her son and another unknown man with a plate of white powder and three green straws.

Yale Galanter, Joseph Lipsey III’s lawyer and the lead attorney in the case against the family told the Aspen Times, “They were looking at a minimum mandatory eight years in prison. Now they’re looking at probation. It’s huge.”

Joseph Lipsey III and Shira Lipsey still each face three felony counts of contributing to the delinquency of a minor and three misdemeanor counts of serving alcohol to minors.

Their son, Joseph Lipsey IV, still faces two counts of felony distribution of drugs, felony contributing to the delinquency of a minor, four counts of possession of a controlled substance and other misdemeanor charges. Joseph Lipsey IV also is facing two counts of felony vehicular assault after crashing his parents’ SUV last fall.
