A Canadian woman has lost a lawsuit against Sun Peaks Resort over a lift accident that occurred seven years ago.
Cathy Morgan, who describes herself as an “expert skier”, was injured when she fell between the chairlift’s lift line and loading area. The local realtor suffered injuries including a dislocation of a hip.
Morgan sued the resort citing negligence. In the lawsuit Morgan stated that after she fell the operator ran to her in an attempt to catch the approaching chair, then ran back to halt the lift. The corporation said the operator immediately hit the ‘stop’ button, then ran to assist.
kamloopsnews.ca reports that B.C. Supreme Court Justice Susan Griffin ruled against the local realtor because “The language of the release in my view uses plain language to bring home to the user of the ski hill that liability for lift operator negligence is being excluded if it is not related to mechanical breakdown or equipment failure.”
