“In the shadows and flat light of that morning, however, Ed could not see the temporary, man-made platform that Deer Valley employees had constructed the night before. It was essentially invisible. As a result, Ed unexpectedly hit the temporary, man-made platform at speed and was launched into the air and over the steep drop-off.” – Ed Bailey’s Attorney

The 56 year old founder of Vision Capital Partners and avid skier, Ed Bailey, spent 27 days in a Salt Lake City hospital and suffered brain injuries after he was launched into the air and fell on his head at Deer Valley Resort on January 22nd. He has filed a lawsuit that claims the accident was caused by the resort regrading an area he was familiar with in preparation for World Cup freestyle event in February but neglecting to post waring signs of the change in terrain according to parkrecord.com.

The lawsuit claims in preparation for the event the resort “substantially re-graded the convergence point of the Big Stick and Solid Muldoon runs the night before” creating “an abrupt lip and steep drop-off” where a  “gentle break-over” normally existed.

The lawsuit claims Bailey was wearing a helmet and skiing under control but could not detect the change in terrain due to flat light and shadows. Deer Valley immediately posted warning signs after the crash. 5 claims have been brought against Deer Valley including negligence and gross negligence.

If you are wondering where the $60 million figure comes from, $30 million of it reflects the lost business his firm suffered from his absence. The firm has not made one investment deal since his accident:

“The firm entirely reliant on Ed for the relationships he has developed over his entire career with key partners of these large funds. Business is suffocating, the network of professional relationships Ed has spent a career developing is withering, and Ed’s income is evaporating.”

Ed continues suffer with physical and emotional effects from the injury including “inappropriate and excessive emotional outbursts and difficulty controlling his temper.”

A Deer Valley spokesperson has made it clear the resort will not comment on the impending lawsuits.
