Following a jury’s verdict, a former Little Nell housekeeper has been awarded $150,000 dollars on the basis that a physical disability was not respected during her tenure working for Aspen Skiing Co. Not accommodating such a disability violates the Americans With Disabilities Act reports The Post Independent.

The suit in question was originally filed back in 2014 and after over a year of deliberation and review, the case went to trial in Denver this past Monday. On Thursday, A jury found that the plaintiff, Arcelia Rojo deserved compensatory damages, which according to investopedia.com is, “money awarded to a plaintiff to compensate for damages, injury, or another incurred loss.”

The suit stems from an incident in which Rojo suffered an elbow injury while cleaning a shower at the Little Nell. That injury resulted in doctor mandated restrictions to her work environment at the Little Nell. The suit claimed that the Aspen Skiing Co. did not do enough to accommodate her needs after the accident. After complaining, Rojo was then transferred to an on-mountain restaurant that is also owned by Aspen Skiing Co.

Once there, she claims that her superiors required her to complete tasks beyond the restrictions laid out by her doctor.

She was later fired by the Aspen Skiing Co., whom she re-applied at a later date. She was not given employment again, which Rojo’s attorney argued was when Aspen Skiing Co violated the ADA.
